Terms and Conditions

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

Participation constitutes entrant’s full and unconditional agreement to, and acceptance of, these Terms and Conditions. The Mobil 1 “Recycle. Scan. Save.” Promotion (the “Promotion”) is offered to individual consumers (“Participant”) recycling empty motor oil containers at participating New Jersey Advance Auto Parts stores (“Participating Location”) for a $5 gift card (“Gift Card”). Promotion begins on December 18, 2020, and ends on May 21, 2021 or while supplies last, whichever comes first. Participant must (1) deposit empty motor oil bottle in the Terracyle recycling bin at Participating Location during the Promotion Period; (2) scan the collection bin’s QR code to receive submission form; and (3) complete and send submission form as directed below to receive Gift Card. Promotion is sponsored by ExxonMobil Oil Corporation, 22777 Springwoods Village Parkway, Spring, TX 77389 (the “Sponsor”) and administered by Theory Communication & Design, Inc. (the “Administrator”).

Offer valid while supplies last. Limit three (3) $5 Advance Auto Parts gift cards per household.

ELIGIBILITY: The Promotion is open to all legal residents of the fifty (50) United States and the District of Columbia who have reached the age of majority in his or her state, or territory of residence and are at least 18 years of age or older as of December 18, 2020.

Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsor, the other Promotion Entities (as defined below) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, employees or officials of any government, or government-owned or government-controlled entity, that has regulatory authority over Exxon Mobil Corporation or any of its affiliates and any and all other companies associated with the Promotion are not eligible to participate or win a prize.

The “Promotion Entities” shall mean organizations directly involved with this Promotion including, Sponsor, Administrator, TerraCycle Inc., and each of their respective subsidiaries or affiliated entities, and their officers, employees and agents.

WAYS TO ENTER: During the Promotion Period, Participants may enter one of two (2) ways after visiting a Participating Location and providing one (1) recyclable motor oil bottle in the provided TerraCycle bin per submission method below, for a maximum of three (3) submissions:

Online:
1. Visit www.RecycleScanSave.com (the “Website”) and follow the on-line registration instructions. Complete the offer form, name, address (no P.O. Boxes except in ND and AK), city, state, zip code, daytime phone number (area code included), and email address. Online submissions must be completed by 11:59:59 p.m. ET on May 21, 2021 to be eligible.
Mail-In
1. If you do not wish to enter via the Internet, you may enter the Promotion and receive one (1) entry by hand-printing your name, address (no P.O. Boxes except in ND and AK), city, state, zip code, daytime phone number (area code included), email address, on a 5″x8″ index card; and
1. Sending the completed 5”x8” index card in a sealed envelope with proper postage affixed to:

Sponsor will use e-mail addresses provided via the Mail-In entry method for prize notification purposes only; however, eligibility to participate in the Promotion is not dependent upon entrant’s provision of this information. Mail-In entries must be postmarked by May 21, 2021 and received by Sponsor no later than May 28, 2021 to be eligible. Mail-In entries become the property of the Sponsor and will not be returned. Sponsor is not responsible for late, lost, damaged, incomplete, misdirected or illegible entries.

LIMIT: Only three (3) entries into the Promotion per person, per mailing address, or email address during Promotion Period, regardless of entry method used. Additional entries received above the limit during the Promotion Period from any person, household address or email address will be void. Once submitted, an entry cannot be deleted, canceled, or modified. All entries become the property of the Sponsor and will not be acknowledged. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant that submits more than the one permitted entry, or who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Promotion.

Receiving your $5 Advance Auto Parts gift card

If you submit your claim online or via mail-in form, you will receive a $5 Advance Auto Parts Gift Card at the mailing address submitted within approximately eight (8) to twelve (12) weeks after receipt and verification of all required documentation. Replacement requests, for any reason, will not be considered after thirty (30) days of shipment. Offer valid only for individual consumers; requests from groups, businesses, clubs or organizations will not be honored. Offer cannot be combined with any coupon and/or discount card. Incomplete, damaged, photocopied, mechanically reproduced, altered and/or forged receipts or offer forms of any kind, or receipts or offer forms not obtained through authorized channels, will not be accepted (except as specifically provided herein for online submissions). Invalid or duplicate requests will not be honored or returned.

TAXES: All federal, state and local taxes, and any other costs and expenses associated with acceptance or use of prize not specifically provided for in these Terms and Conditions are solely the winner’s responsibility.

LIMITATIONS OF LIABILITY: If for any reason this Promotion is not capable of running as planned due to a virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice, and award the prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, indirect, incidental, and consequential damages.

Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not rent, disclose or share personal information or aggregated demographic information with our partners and advertisers. Though we may use an intermediary to conduct promotions, they may not use entrant’s personally identifiable information for any secondary purposes. By participating in the Promotion, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy. Entrant’s information will be used for purposed of direct marketing, research, and monitoring or improving the use and satisfaction of ExxonMobil’s products.

TERMS & CONDITIONS: This Promotion is subject to all applicable federal, state, and local laws. By entering the Promotion, where permitted by law, entrants agree to release, discharge, indemnify, and hold harmless the Promotion Entities, and each of their respective directors, officers, employees, shareholders, and agents from any and all liability, loss, damage, or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Promotion or from their acceptance, receipt, possession, and/or use or misuse of the prize, or for any typographical or other error in the printing, offering, or announcement of the prize. Entrants further acknowledge that the Promotion Entities have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee express or implied, in fact or in law, relating to the prize, including, but not limited to, its quality or fitness for a particular purpose.

By participating, Participant agrees to be bound by these terms and the decisions of Exxon Mobil Corporation (“ExxonMobil”), which are final and binding. ExxonMobil; Theory Communication & Design, Inc.; TerraCycle Inc.; and their respective parents, affiliates and subsidiaries (collectively, “Released Parties”) are not responsible for late, lost, stolen, illegible, damaged, incomplete, misaddressed, misdirected, delayed, inaccurate or postage-due mail, or for any errors of any kind relating to this offer. All requests become the property of ExxonMobil and are nonreturnable. ExxonMobil has no obligation to acknowledge, redeem or return requests not in compliance with these terms. The U.S. Postal Service statutes prohibit acts devised to defraud or to obtain money or property by false or fraudulent means if the postal system is involved. Any person attempting to defraud or in any way tamper with the Promotion mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Terms and Conditions and the decisions of the Promotion Administrator, and waive any right to claim ambiguity in the Promotion or these Terms and Conditions. The Administrator reserves the right to disqualify any entrant that Administrator determines, in its sole discretion, violates these Terms and Conditions. Administrator may end the Promotion at any time during Promotion Period due to supply of recycling bins, or based on individual store restrictions. Promotion limited to availability in select Advance Auto Parts stores in the state of New Jersey only. This Promotion is void where prohibited.

By entering the Promotion, entrants agree that 1.) Any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action; 2.) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion but in no event attorneys’ fees; and 3.) Under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the entrants and Sponsor or the Promotion Entities in connection with the Promotion, shall be governed by, and construed in accordance with United States law. Any legal proceedings arising out of this Promotion or relating to these Terms and Conditions shall be instituted only in the federal or state courts of Texas, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Terms and Conditions. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
